Kirkland routinely advises companies in distressed or otherwise troubled situations. During these representations, our restructuring group is able to leverage its significant experience with both in- and out-of-court restructurings to achieve successful restructuring solutions. Ultimately the proper path towards a successful restructuring, whether in- or out-of-court, is highly dependent on the specific challenges a company is facing. But it is always our goal to reach consensus and hopefully an out-of-court solution. With its well-regarded experience as debtors' counsel in Chapter 11 reorganizations, our restructuring group has a unique perspective on the advantages and drawbacks of proceeding with an in-court solution and works with its clients to determine the best path forward.
Kirkland has successfully counseled many clients on an out-of-court basis. It is our goal, when faced with a troubled situation, to efficiently address clients' challenges and pursue a court-supervised process only when necessary or conducive to the client's objectives.
We regularly assist clients in addressing business challenges through out-of-court mechanisms such as exchange offers, refinancings, venture capital financing, debt conversions, creditor compromises, assignments for the benefit of creditors, and strategic mergers and sales.
