Represented major satellite manufacturer in a $260 million insurance subrogation International AAA arbitration arising out of damage to, and eventual decision to deorbit the satellite designed and built by the client and sold to Space Communications Corporation. Following a two week arbitration and extensive pre-hearing and post-hearing briefing, a three member arbitration panel ruled that the client has no liability beyond relatively small, contractually agreed performance incentives. The insurers' motion to vacate the award was rejected in federal court.

Represented the largest satellite television provider in a federal antitrust monopolization, exclusive dealing and tying case, and one of the largest manufacturers of computer memory chips in criminal and civil, federal and state antitrust price-fixing matters. Prior antitrust work has included trials for clients in the defense, automotive and oil industries.

Represented a major health care provider in nationwide securities law class action and stockholder derivative suits, and a large financial services corporation in nationwide securities law and ERISA class actions. Prior securities work has included trials for both plaintiffs and defendants in cases involving securities fraud, director duties and shareholder rights, as well as contested tender offers and proxy contests.

Represented a major defense contractor in mass tort environmental suits alleging personal injuries and property damage, including class actions and medical monitoring actions, in federal and state court. Prior mass tort and product liability work has included trials concerning helicopter engines, tobacco and breast implants.

Represented that same defense contractor in insurance coverage litigation for the personal injuries and property damage allegedly caused by environmental contamination. Insurance recovery through trials and settlements totaled over $120 million.

Represented the largest manufacturer of communications satellites in a $100 million breach of contract case involving a satellite cellular phone system for Asia and Africa in the London Court of International Arbitration. Prior arbitration experience has included securities, contracts and employment cases before AAA (including AAA International) and NASD panels.

Represented an international communications provider and its satellite manufacturer business partner in a federal patent infringement case involving the development of a global cellular phone system using mid-earth orbit satellites. Prior intellectual property experience has included patent infringement and royalty cases, and trade secret actions, involving missiles, genetic sequencing, and eye medications.
