Professional Profile

Jonathan Putnam is Of Counsel in Kirkland's litigation and intellectual property practice groups.  He has been lead counsel in multiple jury trials, bench trials, and arbitrations in matters involving patents, trade secrets, breach of contract, copyright, fraud, fiduciary duties, and other complex commercial litigation claims.  He has also represented clients in employment claims, class actions, trademarks, antitrust, and computer and other technological issues.  Jonathan has argued appeals in the U.S. Courts of Appeal for the Federal, Second and Eighth Circuits, and in the Delaware and Connecticut Supreme Courts.

Jonathan's experience includes representing clients from Fortune 100 industrial and manufacturing companies, to Internet and other new economy companies, to private companies and individuals.

In January 2007, Jonathan was named one of "Litigation's Rising Stars" by The American Lawyer as one of fifty lawyers, 45 and under, who have made their marks. The American Lawyer called him one of "The Young Litigators Fab Fifty." According to the magazine, "our reporting team sifted through hundreds of names, talking to senior partners, firm managers, and government and public interest lawyers...In the end, we developed a list of lawyers who have not only transcended their status as prized protégés but who seem likely to lead the pack inside the courtroom, at the settlement table, and (for those in private practice) as business magnets, too."

  • First chair in jury trial in federal court in Massachusetts in patent case relating to golf cleats.
  • First chair in three-arbitrator AAA arbitration involving claims for theft of trade secret and copyright infringement relating to computer software program.
  • First chair in jury trial in federal court in Delaware in patent case relating to control system for aircraft auxiliary power units.

Commercial Litigation

  • First chair in bench trial in Delaware Chancery Court in case involving breach of contract claims arising from failed joint venture in electronic chemicals area.
  • First chair in three-arbitrator AAA arbitration involving fraud and breach of contract claims relating to supply contract for microturbine engines.
  • Lead counsel for antitrust case involving pricing and competitive practices in commercial automotive parts industry.

Appellate Litigation

  • Obtained dismissal in trial court on grounds of forum non conveniens and argued Second Circuit appeal in case involving fraud, breach of contract, and fiduciary duty claims arising out of Indian joint venture. 421 F.3d. 129 (2d Cir. 2005).
  • Obtained dismissal in trial court and argued Eighth Circuit appeal in putative class action of employee shareholders.  366 F.3d 606 (8th Cir. 2004).
  • Argued Delaware Supreme Court appeal in case involving types of damages available to successful breach of contract plaintiff.  872 A.2d. 944 (Del. 2005).
  • Obtained dismissal in trial court and argued Federal Circuit appeal in patent case involving on sale bar.  125 F.3d 1448 (Fed. Cir. 1997).
