Representative Matters
Nationwide Insurance / Allied Insurance - Representing Nationwide Insurance and Allied Insurance in hundreds of Hurricane Katrina (Mississippi) and Hurricane Ike (Texas) coverage cases, including the ground-breaking first Katrina case to go to trial in which the Court upheld the validity and enforceability of the water damage exclusion in Nationwide's homeowner's insurance policy, agreeing with Nationwide that it was not obligated to pay for any storm surge damage to plaintiffs’ property. See Leonard v. Nationwide Mutual Insurance Co., 499 F.3d 419 (5th Cir. 2007).
Teva Pharmaceuticals/Barr Laboratories - Representing Teva Pharmaceuticals, Ivax Pharmaceuticals, Sicor Pharmaceuticals, Novapharm USA, and Barr Laboratories in complex multi-state and multi-district litigation involving drug pricing and allegations of Medicaid/Medicare fraud.
Sun Capital Partners, Inc. - Representing Sun Capital Partners and certain of its affiliates as litigation counsel in connection with ongoing bankruptcy matters of affiliate entities.
UTGR, Inc. d/b/a Twin River - Representing UTGR, Inc. d/b/a Twin River, and certain of its affiliates, as lead litigation counsel in their ongoing chapter 11 cases. The Debtors’ principal asset is a casino and greyhound dog-racing facility that is the third-largest source of tax revenue for the State of Rhode Island.
BASF Corporation – Represented BASF in a breach of contract matter in the Southern District of New York, in which a Fortune 100 company sought damages for alleged breach of contract and BASF asserted counterclaims for breach of contract and fraud. The matter was resolved to client’s satisfaction and voluntarily dismissed following summary judgment ruling.
Honeywell International Inc. - Represented Honeywell (formerly AlliedSignal) in a civil fraud case in Polk County, Florida in 2006. After a seven-week jury trial in which the plaintiff sought hundreds of millions dollars, the jury returned a defense verdict and awarded no damages against Honeywell. This case was featured in The National Law Journal’s Ten Winning Attorneys edition for 2006 (June 5, 2006) and was also named to that publication’s 2006 "Defense Hot List." It was also featured in the article “Big Suits: Breed Technologies v. AlliedSignal” in the June 2006 edition of The American Lawyer.
Siemens Energy & Automation, Inc. - Represented Siemens E&A in a breach of contract and trade secret misappropriation arbitration matter in New York City, in which the claimant sought over fifty million dollars in damages. After a three-day hearing, the arbitrators entered an award for Siemens E&A finding no liability and awarding costs and attorneys fees.
