Brad Weidenhammer represents clients in federal and state trial and appellate courts and arbitrations throughout the United States in a variety of practice areas, including products liability, toxic tort, consumer fraud, commercial disputes and contract matters.

Representative Matters

Schlake v. Baxter: Counsel for Baxter in a product liability suit in Cook County, Illinois alleging a defective device caused cardiac arrest and death during experimental intracardiac stem cell injection procedure. Resulted in nuisance-value settlement.

Blum et al. v. Raytheon: Counsel for Raytheon in a product liability suit in the Western District of Texas alleging radiation emitted from radar that guided the Hawk missile system caused plaintiffs’ cancers. Defeated claims of first two bellwether plaintiffs. Remaining 40+ plaintiffs voluntarily dismissed.

In re Hanford Nuclear Reservation: Counsel for DuPont in a Price Anderson Act suit in the Eastern District of Washington alleging that environmental exposure to radionuclides from a plutonium processing facility caused thousands of plaintiffs’ cancers. Resulted in voluntary dismissal of thousands of claims, some low-value settlements, and continued litigation against one plaintiff group.

Dawson v. Boeing: Counsel for Boeing in a personal injury suit alleging exposure to uranium from the Santa Susana Field Laboratory caused plaintiff’s cancer.

Rocky Flats Litigation: Counsel for Dow Chemical in a class action suit in the District of Colorado alleging that plutonium releases from the Rocky Flats nuclear facility diminished class members’ property values. Verdict for plaintiffs was overturned on appeal; a second appeal following remand is currently pending.

Berry v. OmegaFlex: Counsel for Omegaflex, manufacturer of CSST flexible steel gas pipe systems, in putative nationwide product liability class action. Nationwide class settlement.

Petlack v. S.C. Johnson: Counsel for S.C. Johnson in putative deceptive trade practice and consumer fraud class actions alleging improper "green" labeling.

RLP v. PAI: Counsel for PAI in a week long arbitration of a contract claim. Resulted in nuisance-value settlement before closing arguments.

In re General Motors Corp. Dex-Cool Products Liability Litig., MDL No. 1562: Counsel for General Motors Corporation in numerous putative product liability class action lawsuits alleging defects in Dex-Cool coolant and certain intake manifold gaskets. Motion for nationwide class certification denied. Case successfully settled.

Conseco Cost of Insurance Litigation: Counsel for Conseco in an MDL involving putative class actions challenging changes to life insurance charges and attempting to pierce the corporate veil of life insurance company. Class-wide settlement approved by the district court.

Caterpillar v. Esco: Counsel for Esco in a contract dispute with Caterpillar, in which Caterpillar sought a TRO requiring Esco to devote its entire production capacity to supplying Caterpillar. Defeated TRO and renegotiated contract.

Bassett v. Snyder: Counsel for same-sex partners challenging constitutionality of a statute prohibiting municipalities from offering health benefits to unmarried partners in a state where same-sex couples cannot marry. Resulted in summary judgment declaring the statute unconstitutional.

Roadway v. Aon: Counsel for Aon in suit by Roadway alleging bad faith and breach of fiduciary duty by its insurance broker, Aon. Resulted in repeated dismissal of suit followed by low-value settlement.

In re City of Detroit: Represented creditor in connection with the City of Detroit’s Chapter 9 case, the largest-ever municipal bankruptcy case.
