Kirkland & Ellis Partner Dale Cendali Appointed to Serve as Adviser by The American Law Institute

Kirkland & Ellis LLP is pleased to announce that Dale Cendali, partner in Kirkland’s Copyright, Trademark and Internet Practice Group, has been chosen to serve as an adviser on a new project launched by The American Law Institute entitled “Restatement of the Law, Copyright.”

Advisers are selected for their knowledge and experience of the subject or the special perspective they are able to provide. As a group, the advisers on a project constitute an intellectually and geographically diverse collection of practitioners, judges and scholars.

The Restatement of Copyright Law will focus on the generally applicable parts of copyright law including: the subject matter of copyright; the scope of the exclusive rights granted by copyright; copyright “formalities”; the rules governing ownership and transfer of copyrights; the duration of copyright; the standard for copyright infringement; rules regarding the circumvention of copyright protection systems; defenses to copyright infringement, including the first sale limitation and fair use; remedies, including actual and statutory damages, attorneys’ fees, preliminary and permanent injunctive relief; and criminal penalties.

Ms. Cendali is a nationally recognized leader in the field of intellectual property. In 2013, The National Law Journal selected Ms. Cendali as one of the “100 Most Influential Lawyers in America.” The NLJ had previously named her one of “America’s Top 50 Women Litigators,” one of the “50 Most Influential Women Lawyers in America,” and one of “The Most Influential Lawyers” for media and entertainment. Ms. Cendali has repeatedly been ranked as a “top tier” lawyer by Chambers Global and Chambers USA, which describes her as “one of the best lawyers in the country”. She is also an adjunct professor at Harvard Law School, teaching copyright and trademark litigation.
