Mark Holscher is a litigation partner in Kirkland’s Los Angeles office and a former Assistant United States Attorney with extensive lead trial experience on both sides of the courtroom in the country's highest-stakes civil and criminal matters. In the last five years, he has secured over $1.4 billion in plaintiff verdicts and settlements, including multiple nine-figure recoveries, while also successfully defending clients against claims exceeding a billion dollars. In the recent edition of Chambers USA, clients commented that “Mark is the best for bet-the-company litigation. He is who you want in cases you can’t lose,” The Legal 500 U.S. has lauded him as being “among the top litigators in the country,” opposing counsel have described him as “bright and extremely talented,” and peers call him an “extraordinary trial lawyer.” He is a Fellow in the American College of Trial Lawyers and the International Academy of Trial Lawyers, two of the most selective peer-recognition bodies in the trial bar and has been consistently recognized as a leading lawyer in Chambers USA and The Legal 500. Mark advises Fortune 500 companies, private equity sponsors and their portfolio companies, and private and nonprofit organizations across a broad range of complex civil and criminal matters, including securities class actions, government and internal investigations, SEC and FCPA matters, False Claims Act and RICO litigation and criminal defense — frequently in cases involving parallel civil and criminal proceedings. He is one of the few lawyers in the country to have obtained post-indictment dismissals of federal criminal charges across multiple districts, having achieved that result four times, and regularly makes pre-indictment presentations that have persuaded the Department of Justice not to bring charges. He has also served as lead trial and appellate counsel to public companies and their executives in securities-related cases spanning alleged violations of federal securities laws, merger and acquisition and hostile takeover litigation, and fraud and breach of fiduciary duty claims.

Mark is the only California attorney to have received the Daily Journal’s “California Lawyer Attorneys of the Year” (CLAY) award three times — in 2000, 2013 and 2026 — each time for handling a pro bono matter that had a significant impact on law, society and business in the state.
