Overview

Devin is a litigation partner who focuses on complex, difficult, and high-stakes matters at trial and on appeal. Devin has handled appeals in the U.S. Supreme Court, most of the U.S. Courts of Appeals, and several state appellate courts—including obtaining review and winning in the U.S. Supreme Court in Horne v. U.S. Department of Agriculture and Nevada Commission on Ethics v. Carrigan. He has argued dispositive motions in federal and state courts for both plaintiffs and defendants in cases with damages ranging from the low millions to hundreds of millions of dollars. And he has been responsible for helping to oversee, develop, and manage clients’ legal strategies in complicated matters, including parallel federal, state, agency, and bankruptcy proceedings; federal multidistrict litigation; simultaneous class and individual actions; mass torts involving tens of thousands of lawsuits; and claims seeking billions of dollars in damages. Representative clients include Abbott Laboratories, AbbVie, Bionpharma, Boeing, FTI Consulting, Hess, Intel, LightSquared (now Ligado Networks), Motorola Solutions, Phillips 66, Pfizer, Teva Pharmaceuticals, Siemens, St. Jude Medical, Textron, UBS, and Syngenta.

Frequently asked to address critical issues in precedent-setting and bet-the-company litigation, Devin represents and counsels clients spanning an array of industries, including automotive, consulting, oil and gas, biotechnology, telecommunications, pharmaceuticals, agriculture, aviation, investment and financial services, and emerging technologies. Devin has personally handled a wide range of subject matters, such as administrative law, antitrust, bankruptcy law, class actions, environmental law, ERISA, intellectual property, international and foreign law, federal and state constitutional law, justiciability and jurisdiction, securities litigation, and state contract, tort, and products liability law. He also represents and advises clients on strategic legal issues involving the relationship between federal and state law—such as the constitutionality of state ballot initiatives, the federal common law of foreign relations, federal jurisdiction under the Class Action Fairness Act, challenges to laws under the Dormant Commerce Clause, the determination of foreign and international law, and federal and state preemption.

Before joining the Firm, Devin was a law clerk for now-Chief Judge D. Brooks Smith of the U.S. Court of Appeals for the Third Circuit and Judge Amul R. Thapar of the U.S. District Court for the Eastern District of Kentucky (now Circuit Judge on the U.S. Court of Appeals for the Sixth Circuit).

While at Kirkland, Devin has also maintained an active pro bono practice. He has, for example, obtained a complete reversal of a criminal defendant’s conviction based on the government’s Brady violation, successfully represented raisin farmers in their Supreme Court case challenging the federal government’s unconstitutional taking of a portion of their crops, and successfully obtained remand of an alien’s petition for deferral of removal under the Convention Against Torture.
