INEOS v. BASF — Defeated preliminary injunction and won voluntary dismissal of lawsuit brought by INEOS seeking to enjoin the sale of BASF’s polyolefin catalysts business to W.R. Grace.
Florida v. Georgia — Counsel for the State of Georgia in a rare “original jurisdiction” dispute with Florida pending in the Supreme Court of the United States. The case is being litigated before a Special Master appointed by the Court to conduct discovery and trial proceedings.
In re Caterpillar Inc. Securities Litigation — Counsel for Caterpillar in putative securities fraud class action. Successfully obtained dismissal of the case on a motion to dismiss.
Luca v. Wyndham — Counsel for Wyndham in putative nationwide class action challenging hotel billing practices.
Cerberus v. Canadian Imperial Bank of Commerce — Counsel for Cerberus-affiliated investment vehicles in lawsuit bringing breach of contract claims against CIBC, stemming from CIBC’s payment obligations related to cash and synthetic assets in its U.S. residential housing portfolio.
In re Magnum Hunter Resources Corporation — Counsel for Magnum Hunter Resources Corporation and its subsidiaries, in its successful valuation trial in its Chapter 11 cases in the United States Bankruptcy Court for the District of Delaware.
Moore v. Raytheon — Counsel for Raytheon in ERISA litigation relating to retiree health benefits at Raytheon’s Tucson missile facility.
Caterpillar Derivative Actions — Counsel for Caterpillar in multiple shareholder derivative actions filed in the Delaware Court of Chancery.
UTC class actions (C.D. Cal., S.D. Fla., E.D. Pa.) — Counsel for UTC in putative class actions alleging warranty and consumer protection claims relating to HVAC units.
Counsel to global financial institution in federal antitrust class actions alleging that foreign currency dealers conspired to manipulate the benchmark WM/Reuters currency exchange rate.
