Gamm v. Sanderson Farms, Inc. Represented Sanderson Farms and its executives in putative securities fraud class action regarding the company’s compliance with antitrust laws. Prevailed on motion dismiss; affirmed on appeal. See 2018 WL 1319157 (S.D.N.Y. Jan. 19, 2018), aff’d 944 F.3d 455 (2d Cir. 2019).
In re Blue Cross Blue Shield Antitrust Litigation. Currently represent BlueCross and BlueShield Association and other defendants in putative, consolidated class actions brought by all Blue insureds and all healthcare providers challenging the structure of the BlueCross BlueShield system under the antitrust laws. Successfully obtained summary judgment for two defendants. See 2016 WL 6124143 (N.D. Alabama Oct. 20, 2016).
In re Cobalt International Energy, Inc. Represented Cobalt International Energy, Inc. and its subsidiaries in their Chapter 11 cases in the United States Bankruptcy Court for the Southern District of Texas and in related adversary proceedings. After a hotly contested plan process, the bankruptcy court confirmed Cobalt’s Chapter 11 plan in April 2018. Successfully defended Cobalt’s plan on appeal. In re Class 8 Transmission Indirect Purchaser Antitrust Litigation. Represented Navistar Corp. in successfully defending against putative antitrust class action brought by purchasers of Class 8 heavy duty trucks alleging an agreement to monopolize the heavy duty truck transmissions market. See 679 Fed. App’x. 135 (3d Cir. 2017).
Miller UK Ltd. v. Caterpillar, Inc. Represented Miller in an eight-week jury trial alleging theft of trade secrets and breach of contract by Caterpillar. Jury verdict of $74 million for Miller, representing full amount of requested damages. Settled on appeal.
