Representative Commercial Litigation Matters
Bund v. Safeguard Properties LLC (W.D. Wash.): Represented Safeguard in connection with a federal class action brought by Washington homeowners challenging certain property preservation practices. Achieved the decertification of the class and dismissal of all claims.
In re Legacy Reserves LP Preferred Unitholder Litigation (Del. Ch.): Represented Legacy Reserves in connection with a class action brought on behalf of Legacy’s preferred unitholders challenging a restructuring transaction. Achieved a favorable settlement allowing the restructuring transaction to go forward without the payment of any additional cash consideration.
Liqui-Box, Inc. et al v. DS Smith (UK) Limited et al. (S.D.N.Y.): Represented Liqui-Box and Olympus Partners in litigation arising from Liqui-Box’s pending $585 million acquisition of the plastics division of D.S. Smith. Achieved a favorable settlement allowing the acquisition to go forward.
In re National Prescription Opiate Litigation (N.D. Ohio): Representing Allergan in a federal multidistrict litigation proceeding and hundreds of state court lawsuits brought nationwide by State AGs, counties, and municipalities related to the marketing of prescription opioids.
Monterey Bay Military Housing, LLC, et al. v. Ambac Assurance Corporation, et al. (S.D.N.Y.): Representing 18 privatized military housing projects as plaintiffs in a federal RICO action alleging fraud and breaches of fiduciary duty against financial advisors, lenders, and bond insurer.
Representative Restructuring Litigation Matters
Windstream Holdings, Inc. et al. v. Uniti Group Inc. et al. (Bankr. S.D.N.Y.): Represented Windstream and certain affiliates in connection with an adversary proceeding seeking to recharacterize a $650 million-per-year lease agreement as a disguised financing arrangement. Achieved a favorable settlement, the largest recovery based primarily on a recharacterization claim in history.
In re Avaya Inc., et al. (Bankr. S.D.N.Y.): Represented Avaya and certain affiliates in connection with its Chapter 11 proceedings, including contested confirmation proceedings and an estimation proceeding related to antitrust claims made against Avaya.
In re Cenveo Inc., et al. (Bankr. S.D.N.Y.): Represented Cenveo and certain affiliates in connection with its Chapter 11 proceedings, including an investigation of Debtors’ potential causes of action and contested confirmation proceedings.

People of the State of Illinois v. W.B. (Ill. Cir. Ct.): Brought and argued the first petition under a newly-enacted Illinois statute allowing domestic violence to be considered a mitigating factor in sentencing. Achieved an order applying the statute retroactively, resulting in the release of the client, twenty-five years before the end of the original sentence.
K.K. v. Walker, et al. (N.D. Ill.): Brought a Section 1983 action against the Illinois Department of Children and Family Services alleging constitutional violations arising from the unfounded removal of the client’s children from her custody. Achieved a favorable settlement.
