Penny is an associate in the Shanghai office of Kirkland & Ellis International LLP. Her practice focuses on internal investigations and government enforcement actions. She has experience counseling multinational companies on legal and internal controls issues that implicate the U.S. Foreign Corrupt Practices Act (“FCPA”) and other bribery laws, accounting and book-keeping standards, economic sanctions laws, and antitrust and competition laws. She has advised clients from the pharmaceutical and medical device, finance and investment, agricultural, energy, and online education industries.

Conducted internal investigations and advised compliance issues for numerous companies in multiple industries, such as pharmaceutical, medical device, and online education industries
Advised multinational pharmaceutical and medical device companies on internal investigations related to various issues including embezzlement, sales data manipulation, channel stuffing, product registration, sponsorships and grants, third party and distributor management
Advised pharmaceutical and medical device companies with regard to responding to Chinese government investigations
Advised the Audit Committee of a U.S. listed Chinese peer-to-peer lending company in response to short-seller allegations related to accounting fraud and other misconduct
Advised a China-based agricultural company in an investigation brought by the U.S. Securities and Exchange Commission (SEC) relating to accounting fraud and FCPA issues
Litigation
Advised a leading Chinese solar panel manufacturer in defending a high-profile anti-trust lawsuit in the U.S.
Advised a global agricultural company in a multi-billion dollar cross-border litigation alleging damages related to the commercialization of a genetically modified trait in the U.S. before receiving approval from Chinese authorities
