Brandon D. Stone
Overview
Brandon Stone is a litigation partner in Kirkland's Chicago office. His practice focuses on complex commercial cases at both the trial and appellate levels, and on government and internal investigations. He has represented clients in judicial and administrative proceedings, including class actions, across a broad array of subjects, including commercial law, employment law, fraud, trade secrets, and financial litigation.
Before attending law school, Brandon served from 2005 to 2012 as a SEAL officer in the United States Navy.

- Counsel for technology company in DOJ- and SEC-facing investigation into alleged material misstatements made while soliciting investments.

- Counsel for private equity client responding to a subpoena from U.S. Department of Treasury’s Office of Foreign Asset Control related to a portfolio company’s transactions.

Antitrust
- In re Humira Antitrust Litigation (N.D. Ill.; 7th Cir.) Counsel for AbbVie in multi-defendant antitrust case regarding AbbVie’s Humira, the best-selling drug in history, where plaintiffs assert that AbbVie amassed a “patent thicket” of over 100 patents and entered anticompetitive settlement agreements with biosimilar manufacturers. District court granted motion to dismiss with prejudice.
False Claims Act
- U.S. ex rel. Schutte v. Supervalu and U.S. ex rel. Proctor v. Safeway (C.D. Ill.; 7th Cir.) Counsel representing defendants in False Claims Act case where whistleblower asserted pharmacies submitted tens of millions of fraudulent Medicare claims over nearly a decade when offering discounts to uninsured customers. District court granted summary judgment for defendants and dismissed all claims.

Burton v. Ghosh, et al. (7th Cir. and N.D. Ill.) Counsel representing prisoner plaintiff asserting Eighth Amendment claims of deliberate indifference of serious medical needs under 42 U.S.C. § 1983. Took over case on appeal after dismissal with prejudice. Successfully briefed and argued for reversal and remand before the Seventh Circuit. Burton v. Ghosh, 961 F.3d 960 (7th Cir. 2020). Case is awaiting trial.
Coulibaly v. Pompeo (D.D.C.) Counsel representing plaintiff former government employee asserting claims of discrimination and retaliation under Title VII of the Civil Rights Act of 1964 and the Family Medical Leave Act. Case is awaiting trial.
