The America Invents Act (AIA) created inter partes review (IPR), post-grant review (PGR), and covered business method review (CBMR) proceedings. These proceedings are regularly used to challenge the patentability of issued United States patents. The Patent Trial and Appeal Board (PTAB), formerly known as the Board of Patent Appeals and Interferences, administers these proceedings in an expedited manner. All proceedings are “trials” and offer limited discovery, briefing and motion practice, and oral argument.
