Antitrust Litigation

• United States of America et al v. UnitedHealth Group (D.D.C.). Represented UnitedHealth Group and defeated the Department of Justice’s attempt to block UnitedHealth’s $13 billion acquisition of Change Healthcare.
  
• In re Generic Pharmaceuticals Pricing Antitrust Litigation (E.D. Pa.). Representing Upsher-Smith Laboratories in a multidistrict class action litigation alleging a generic drug price-fixing conspiracy. In 2017, the court granted Upsher-Smith’s motion to dismiss certain state law claims. The case is ongoing as to the remaining claims.
  
• DPWN Holdings (USA), Inc. v. United Airlines, Inc. (E.D.N.Y.). Represented United Airlines in a billion-dollar antitrust lawsuit brought by DHL alleging that United conspired with other airlines to fix surcharge prices in the global air cargo industry. Successfully resolved shortly before trial.

Products Liability Litigation

• In re Valsartan N-Nitrosodimethylamine (NDMA) Contamination Product Liability Litigation (D.N.J.). Representing Torrent Pharmaceuticals in multidistrict class action litigation arising from recalls of the generic blood pressure drug valsartan.

Trade Secrets Litigation

• Alabama Aircraft Industries, Inc., et al. v. The Boeing Company (N.D. Ala.). Representing The Boeing Company in a dispute brought by a former Boeing subcontractor, alleging misappropriation of trade secrets and financial information arising out of the United States Air Force’s award of a multi-year contract to Boeing. In 2018, the court granted Boeing’s motion to enforce the damage limitation provision, eliminating over $100 million in damages.
• DSM Dyneema LLC v. Thagard, et al. (NC). Represented Honeywell and won summary judgment in lawsuit alleging that Honeywell misappropriated trade secrets when it hired an employee who previously worked at a competitor and subsequently obtained a contract to supply the Enhanced Combat Helmet to the U.S. military. This case was featured in the Reuters article “Honeywell Knocks Combat Helmet Trade Secrets Case on its Head” in July 2018.

Commercial Litigation

• Zydus Worldwide v. Teva (NY, D.N.J.): Representing Teva Pharmaceuticals in litigations alleging breach of an asset purchase agreement and letter of intent relating to generic Rotigotine products sold under the brand name Neupro®.
• Chesapeake Energy (various matters). Currently representing Chesapeake Energy and corporate affiliates in numerous class and individual actions brought by lessors challenging royalty payments pursuant to oil & gas leases in Ohio and Pennsylvania, in state and federal courts and before arbitration panels. Won summary judgment in multiple cases. Henceroth v. Chesapeake Exploration, L.L.C., 2019 WL 4750661 (N.D. Ohio); Lutz v. Chesapeake Appalachia, L.L.C., 2017 WL 4810703 (N.D. Ohio); Zehentbauer v. • Cognizant Technology Solutions (various matters). Counsel to Cognizant in multiple matters related to ERP implementations, including Conduent Business Services, LLC v. Cognizant Business Services (NY).
