Antitrust

• In re Modafinil Antitrust Litigation — Representing drug manufacturer in government enforcement, class action and opt-out litigation regarding modafinil.
• In re Ovcon Antitrust Litigation — Represented drug manufacturer in government enforcement, class action and opt-out litigation regarding oral contraceptive Ovcon. Won partial summary judgment then settled with FTC, class and opt-out plaintiffs on favorable terms.
• Zydus Pharmaceuticals v. Teva Pharmaceuticals — Represented drug manufacturer in antitrust case brought by competitor regarding alleged anticompetitive conduct in API market for risperidone. Settled case for no damages.
• In re Cipro Class Action Litigation — Represented pharmaceutical manufacturer in class action and opt-out litigation regarding the antibiotic ciprofloxacin; won summary judgment and Federal Circuit appeal.
• Netscape v. Microsoft — Successfully represented Netscape Communications Corp. against Microsoft Corp. for antitrust violations, leading to a $750 million settlement for Netscape and its parent AOL-Time Warner.
• In re DRAM Antitrust Litigation — Worked on various matters for DRAM manufacturer in connection with DOJ Antitrust Division price-fixing investigation, horizontal conspiracy class actions, and antitrust defenses and counterclaims in Rambus litigation.
• In re Vitamins Antitrust Litigation — Defended one of numerous corporate client defendants (who had reached plea agreements with DOJ) in multi‑district litigation regarding alleged price‑fixing in the vitamin industry. Settled with class and opt-out plaintiffs on favorable terms.
• FTC v. Abbott Labs — Won trial victory for Abbott Laboratories in $50 million federal court antitrust action brought by Bureau of Competition under Section 5 of the FTC Act.

Product Liability

• "Comfort Feature" Seatbelt Litigation — Trial counsel to GM in numerous cases involving alleged seat belt defect resulting in injuries in crashes, including a defense jury verdict at trial in New York City. 
• C/K Pickup Truck Class Action Litigation — Trial counsel to GM in numerous cases alleging side-mounted gas tanks in full-size pickup trucks were unreasonably dangerous. Played key role on trial teams in individual injury cases and assisted in negotiation and approval of nationwide class action "coupon" settlement of consumer claims. 
• Automotive Door Latch Class Action Litigation — Won summary judgment for General Motors in major product liability class actions alleging defects in GM's Type III door latches as part of federal MDL. Trial counsel in numerous individual state court actions. 
•  — Represented GM in class actions alleging seat backs of certain GM automobile models were defective and collapsed in collisions. Obtained dismissals based on lack of failure/injury.  Remaining cases currently stayed. 
• Jean Windsor v. Abbott Labs — Counsel in DES pharmaceutical product liability case in Birmingham, Alabama.

Healthcare/Fraud/RICO/ERISA

• Counsel to Blue Cross Plans in Federal Discount Litigation — Successfully defended Independence Blue Cross in federal co‑pay litigation. 
• Counsel to Blue Cross Plans in Kmart v. BCBSM, et al. — Defended Independence Blue Cross, Trigon Blue Cross, and HCSC in action brought by Kmart Corp. involving ERISA, RICO, breach of contract, and fraud allegations regarding provider discount reimbursement. Settled for a fraction of potential damages. 
• Counsel to Independence Blue Cross in Health Benefit Matters — Successfully represented Independence Blue Cross in Department of Labor investigation regarding provider discounts, and other regulatory matters.

Intellectual Property

• Counsel to BioChem Pharma Inc. in Federal Securities Litigation — Won total victory for corporate and defendant director clients in federal securities fraud action on a motion to dismiss. Currently representing client in the Fourth Circuit in connection with plaintiff's appeal.
• Counsel to Heidelberg Harris, Inc. in Patent Infringement Litigation — Obtained summary judgment on all claims for patent infringement and conversion. Argued appeal in Federal Circuit, which affirmed on all grounds.
• Counsel to KBA‑Motter Corp. in Patent Assignment Litigation — Obtained for KBA‑Motter Corp. (as replacement counsel) a new trial on damages and successfully obtained 75% reduction of original assessment and affirmance of same on appeal to Third Circuit.
• Counsel to Hughes Aircraft Co. in Patent Licensing Litigation — Obtained dismissal on 12(b)(6) motion of all claims by patent owner and obtained affirmance and sanctions against plaintiff in subsequent appeal to Federal Circuit.
• Counsel to Hughes Aircraft Co. in Patent Infringement Litigation — Helped obtain multimillion dollar settlement for Hughes as plaintiff in suit for infringement of patent on geosynchronous orbital satellites.
