IP Litigation Department of the Year - Finalist

Kirkland was named a finalist for IP Litigation Department of the Year in American Lawyer Media's biennial survey. Robert Krupka received praise for his $510 million jury award for Dr. Gary Michelson, an inventor of spinal surgery devices. After the trial, Mr. Krupka worked out a settlement for $1.35 billion, in which Medtronic purchased 500 patents from Dr. Michelson. This is the largest public patent settlement in history.

Also highlighted were two big wins for John Desmarais. Mr. Desmarais won a discovery battle for client, Infineon Technologies AG against Rambus Inc. This led to a settlement that ended an expensive patent battle, and left Infineon with an edge over its competitors. Mr. Desmarais was also mentioned for winning a significant patent infringement case for Boston Scientific against Johnson & Johnson in July 2005.

Other victories mentioned were David Callahan's summary judgment win for Amazon, Inc., in a case brought by IXPL Holdings; Peter Armenio's win for Boston Scientific against Medtronic over stents; and Daniel Attridge's and Edward Donovan's win for Barr Laboratories, allowing Barr's generic diabetes drug to go to market.
