Overview
Patrick Arnett is an intellectual property litigation partner in the Washington, D.C., office of Kirkland & Ellis LLP. His practice focuses on patent and trade secret litigation and counseling in a variety of technical fields, including software, cloud computing, consumer electronics, RFID, automotive, artificial intelligence, wireless networking and semiconductor technology. Patrick has played an integral role on case teams in federal courts, as well as before the USPTO and ITC. He has achieved numerous favorable outcomes for clients at all stages, including early resolution of cases, in dispositive motions, and at trial. He also has experience in witness examination, oral argument and all aspects of discovery.
Experience
Representative Matters
Represented a global automobile manufacturer in district court and in IPR proceedings, leading technical analysis and defensive strategy for several wireless standard-essential patents in cooperation with suppliers and joint defense group members. After institution of several IPRs, the parties settled.
Defended a leading smartphone, tablet, and Internet-enabled appliance manufacturer in litigation involving error-correction encoding in Wi-Fi. Achieved a favorable settlement after winning critical pretrial motions that substantially minimized the client’s damages exposure.
Successfully defended a prominent video game company against copyright claims concerning the depiction of tattoos on athletes and performers. At trial, the plaintiff requested $27.3 million, but the jury awarded only $3,750 in actual damages and none of the defendants’ profits.
Represented a leading clinical trial software company in trade secret theft and unfair competition litigation against rival in the life sciences cloud computing industry.
Defended a leading provider of intelligent transport solutions in an International Trade Commission (ITC) investigation involving radio-frequency identification readers for electronic tolling, achieving an extremely advantageous settlement terminating the investigation and all pending litigation.
Defended a global manufacturer of image sensors and imaging signal processors for smartphones and tablets in an International Trade Commission (ITC) investigation involving multiple patent and trade-secret claims. Achieved a licensing agreement terminating the investigation and all pending litigation.
Represented global e-commerce company in multi-venue, multi-patent dispute related to desktop and mobile shopping, promotion, and product discovery solutions. Achieved cross-licensing agreement terminating all pending litigation.
Defended providers of vehicle and asset tracking technology in a patent infringement action involving 115 claims of seven patents. After multiple venue challenges and invalidation of all challenged claims in inter partes review (IPR) proceedings, achieved a favorable settlement terminating the litigation.
Defended designers of low-latency network cards and switches against a competitor in a patent infringement action. After initiating IPR proceedings challenging claims of several asserted patents, achieved a favorable settlement terminating the litigation.
Advises clients in the semiconductor and open-source software industries on developing, maintaining, and leveraging patent portfolios effectively, both offensively and defensively.
