• Thomson Reuters Enterprise Centre GmbH et al v. ROSS Intelligence Inc. (D. Del.): Representing Thomson Reuters and West Publishing in a copyright and tortious interference lawsuit concerning ROSS’s copying of Westlaw’s content to train its competing product’s artificial intelligence model. Won summary judgment, obtaining the first decision in legal history holding that such copying was not fair use. The court also held that Thomson Reuters’ content was original and infringed by ROSS, and that West’s tortious interference claim based on violating the Westlaw anti-bot and password-sharing provisions was not preempted by the Copyright Act.
• Represented major video game company in a copyright infringement lawsuit regarding alleged infringement of choreographic work. The parties reached a confidential settlement.
• Deloitte Consulting LLP v. Sagitec Solutions LLC (D. Del.): Represented Deloitte in a copyright, trade secret, and unfair competition case concerning use of its unemployment insurance software by a competitor. Just weeks before trial, the parties reached a confidential settlement.
• MaxLinear v. Comcast (S.D.N.Y.): Representing MaxLinear in trade secret misappropriation litigation against Comcast regarding proprietary amplifier technology.
• Represented insurance company in a trade secret and patent lawsuit regarding proprietary software. The parties reached a confidential settlement
• Representing a major social media and technology company in federal trademark infringement litigation.
• Representing plaintiff pharmaceutical company in antitrust and improper patent listing litigation.
• Representing a major storage company in a trade dress and trademark declaratory judgment action.
• Trademark Litigation (T.T.A.B.): Represented a leading computer, mobile device and media player company in a trademark action brought by a renewable energy company involving emoticons concluding in voluntary withdrawal of the opposition with prejudice.
