Richard Boynton is a partner in the Firm's international litigation and arbitration group in London. Richard has extensive experience leading teams representing multi-national corporations, credit funds, private equity funds and international banks in litigation and arbitration throughout the world. Richard’s cases cover a variety of sectors and laws. Richard was described in The Legal 500 UK 2021 as “one of the best commercial litigation solicitors I’ve come across” and “Pound-for-pound he’s as good a commercial litigation solicitor as you could find.”

Representative Matters
Commercial Litigation
- Acting for Altera Infrastructure L.P. in pre-arranged Chapter 11 cases filed in the Bankruptcy Court for the Southern District of Texas.
- Acting for Galapagos Bidco Sarl in: (i) its proceedings in England seeking a declaration that the restructuring of around $1 billion complied with the intercreditor agreement; and (ii) coordinating its Defence to actions brought in New York, Germany and Luxembourg challenging the steps taken in the restructuring.
- Acting for a firm which saw the significant trades it executed on a recognised exchange cancelled.
- Advised an ad hoc group of the major third party financial creditors of the Steinhoff retail conglomerate on the highly complex, multi-jurisdictional settlement of c.€10 billion litigation proceedings. This follows the restructuring of c.€9 billion third party financial indebtedness in 2019 in respect of which Kirkland advised an ad hoc group of convertible bondholders.
- Acted for the seller of $1.2bn European holidays business in a series of post-completion claims and counterclaims against the purchaser.
- Acted for a private equity company in successfully resisting an application to force it to acquire an airline.
- Acted for multiple companies in resisting challenges to the various restructuring processes they have undertaken.
- Acted for the seller of a property developer in a £51 million completion accounts dispute which was referred for expert determination.
- Acted for a private equity purchaser in a claim against the seller of a mobile phone manufacturing business.*
- Acted for a shareholder and lender to a group of international companies in respect of an unfair prejudice petition in England.*
- Advised a subordinated bondholder in respect of the restructuring of the debt owed by the owners of Battersea Power Station.*
- Acted for the manufacturer of allegedly defective electrical equipment in a dispute with its customer and suppliers.*
Arbitration
- Acting for a pharmaceutical company in a series of cross border arbitrations worth many hundreds of millions of Euro.
- Acted for the claimant in international arbitration proceedings arising out of the largest ever insolvency in Spain.
- Acted for a major US corporation in a series of cross border international arbitrations against a quasi-state owned entity in the Middle East.
- Acted for a multi-national defence manufacturer in a complex international arbitration arising out of the termination of a major IT project which encountered significant delays.*
- Assisted with an LCIA arbitration arising out of a quota share reinsurance treaty.*
- Assisted with a number of ad hoc arbitrations in relation to PA/Workers compensation reinsurance "spiral" issues.*
Banking Litigation
- Acted for a credit fund in proceedings against a Greek bank arising out of the sale of a portfolio of non-performing loans.
- Defended a major international bank in a number of swaps mis-selling claims following the alleged manipulation of LIBOR.*
- Acted for a French bank obtaining worldwide freezing orders from the English Court against a series of companies who misappropriated large amounts of gold; overseeing litigation in Turkey and Dubai arising out of the theft of the gold and acting in English proceedings against the bank’s insurers.*
- Acted for Issuer of a large number of Principal Protection Bonds in proceedings brought by the Bondholder against the Issuer, Trustee and the bank which bore the economic risk of the bonds failing to perform.*
- Acted for an international bank against the owner of a mine in China. The case involved detailed analysis of the value of various options issued by the Chinese company.*
- Acted for an international bank in a mis-selling claim brought by the Vatican bank.*
- Advised a French Bank on its open positions following the administration of Landsbanki.*
- Acted for a bank subject to a European Commission investigation into the development of exchange traded Credit Default Swaps.*
