Overview
Fan Chen is an IP litigation associate in the Bay Area office of Kirkland & Ellis LLP. Fan’s practice focuses on patent disputes and trade secret misappropriation. Fan has worked on a variety of complex matters across a broad spectrum of technologies, including enterprise IT solutions, AdTech, fleet telematics, telecommunications, consumer electronics and industrial process control applications. She is experienced in various stages of litigation, including pre-filing investigation, fact discovery, expert discovery, motion practice and jury trial.
Fan maintains an active pro bono practice, representing clients in matters involving Section 1983 and Federal Tort Claims Act claims.
Experience
Representative Matters
Represented a leading fleet telematics provider (plaintiff) in a patent infringement suit against a competitor. After trial in the Southern District of California, the jury rendered a verdict in favor of the plaintiff, finding willful infringement and awarding $19.3 million in damages.
Represented an American multinational information technology (IT) services and consulting company in a trade secret, breach of contract, and tortious interference with contract lawsuit. The case settled favorably before trial.
Defending a Fortune 500 material science and chemical manufacturing company in a trade secret, copyright, and breach of contract lawsuit concerning advanced process control technology.
