Elliott Davis is a litigation partner in the Washington, D.C., office of Kirkland & Ellis LLP. His practice focuses on complex legal issues at the trial and appellate stages. He has been the primary author of dozens of appellate briefs filed throughout the country, and has argued and won before the Tenth Circuit, the New York Appellate Division, a three-judge federal district court and several federal and state trial courts nationwide.
Before joining Kirkland, Elliott served at the U.S. Department of Justice, where he led the successful defense of the United States in several high-profile lawsuits, including constitutional challenges to the 2020 decennial census, a constitutional challenge to Title IX’s religious exemption and tort actions concerning alleged torture at Abu Ghraib prison, the terror attack in Benghazi and alleged corruption at the FBI’s Boston Field Office. Elliott was also detailed to the Department’s Civil Rights Division, where he served as its second-in-command and contributed to several Supreme Court and Court of Appeals briefs. He is the recipient of multiple Department of Justice honors, including the Attorney General’s Award for Distinguished Service.
