Representative Matters
Prior to joining Kirkland, Stuart’s recent representations include:
Banking Litigation
- Acted for a financial institution in a significant multi-jurisdiction civil claim in the English High courts in which it is alleged that in excess of US$830 million has been misappropriated.
- Acted for global asset management firm in English High court proceedings seeking relief for unjust enrichment relating to failed real estate transaction.
- Acted for the bankruptcy administrator of Bankas Snoras, formerly the third largest bank in Lithuania.
- Acted for PricewaterhouseCoopers (PwC) as administrators of Lehman Brothers International (Europe) and all other Lehman entities in administration, the largest and most complex insolvency in history.
- Advised a range of FI and AMIF clients on civil justice matters arising from Brexit (and beyond), including recognition and enforcement of governing law and jurisdiction clauses, conflicts of laws, process agents, enforcement and parallel proceedings.
Commercial Litigation
- Acted for a European airline defending an aircraft leasing dispute in English High court proceedings for more than £25 million.
- Acted for high net worth individual in English High Court property dispute and related proceedings in other EU jurisdictions.
- Acted for News Group Newspapers on the phone hacking group litigation in the High Court.
Investigations
- Acted for global banks and asset management firms and investment funds in relation to regulatory investigations, including most recently:
- responding to regulatory enforcement action relating to breach of Interchange Fee Regulations;
- responding to whistle blowing allegations and allegations by US short seller into funds trading outside of mandate and related issues;
- leading an internal investigation relating to the setting of sales credits during an issuer auction process; and
- advising principal (and asset management firm) on application for approval to perform controlled functions (fitness and proprietary) and appeals to the FCA’s Regulatory Decisions Committee.
