Since joining Kirkland, Caroline has been involved in the following:

• Represented Abbott Cardiovascular Systems, Inc in a global litigation involving MitraClip, a medical device for the treatment of life threatening heart problems. Before this case reached a settlement, drafted POPR briefing resulting in denials of all five of Edward’s inter partes review challenges at the earliest and most difficult stage for such proceedings. At the time, petitions like these were allowed to proceed to later stages more than 60% of the time, making Kirkland’s early, five-out-of-five victory a rare achievement.
• Represented Abbott Diabetes in global litigation against Dexcom, involving several patents related to continuous glucose monitoring devices for people with diabetes. Secured a jury trial win on several claims in 2023, litigation remains ongoing.
• Successfully defended Alcon in a patent and copyright lawsuit concerning laser eye surgery technology, including defeating a preliminary injunction motion that sought to enjoin Alcon’s LenSx system sales, winning summary judgment motions based on the copyright statute of limitations and related-J&J entities not being beneficial owners of the asserted works, and defeating J&J’s motion for summary judgment on ownership of the asserted software. The case was settled prior to trial.
• Defended a pharmaceutical company and its supplier of body contouring products in a patent-based ITC investigation. The parties settled on the last day of trial.

Prior to joining Kirkland, Caroline was involved in the following:

• Member of trial team for Praxair, Inc. in two-week ANDA trial against Mallinckrodt Pharmaceuticals involving 11 patents related to pharmaceutical product (INOMAX) and associated delivery system, a product with revenue of over $400 million. The district court ruled that five of the asserted patents were invalid and the other six asserted patents were not infringed, resulting in a complete victory for Praxair.
• Member of trial team for Milwaukee Electric Tool Corp. in a two-week jury trial regarding lithium-ion battery technology in the Eastern District of Wisconsin. The jury returned a verdict finding entirely in Milwaukee Tool’s favor, awarding damages of $27.8 million and finding defendant’s infringement was willful. This was identified as one of the “Top 100 Verdicts of 2017” by ALM.
