• United States v. Apple — Defense counsel for Apple against the Department of Justice alleging monopolization of the smartphone market.
• United States v. UnitedHealth Group — Represent UnitedHealth Group in Department of Justice investigation and litigation challenging its acquisition of a home health and hospice company.
• In re Namenda Antitrust Litigation — Defense counsel for Allergan in reverse payment and product hopping class action relating to the development and launch of new Alzheimer’s treatments.*

Commercial Litigation

• Represent software company in Delaware Chancery lawsuit alleging unfair competition, tortious interferences with prospective business relations, breach of contract and violation of the Computer Fraud and Abuse Act.
• Tera II v. Rice Drilling — Trial counsel for Gulfport in lawsuit seeking over $100 million brought by large landowners in Ohio. Obtained a complete jury verdict for Gulfport, a result profiled in The American Lawyer.
• McEvoy v. Diversified Energy Co. — Defeated class certification in lawsuit alleging fraud and regulatory violations against Diversified.
• Anthem, Inc. v. Express Scripts, Inc. — Counsel for Anthem in a multi-billion dollar lawsuit against its pharmacy benefits manager, Express Scripts.*

Criminal Matters

• United States v. Usher — Trial counsel for London-based JP Morgan Chase banker against the Department of Justice alleging antitrust conspiracy to price-fix foreign exchange rates. Obtained complete acquittal after a three-week criminal jury trial in the Southern District of New York.*
• Confidential tax — Obtain a declination of prosecution following investigation of individual for potential criminal tax violations by the Manhattan District Attorney.*

Products Liability

• In re ZF-TRW Airbag Control Units — Defense counsel for ZF TRW in multi-district litigation encompassing more than two dozen nationwide class actions alleging breach of warranty, fraud and other claims based on allegedly defective airbag control units.

Restructuring

• In re Honx, Inc. — Represent HONX, Inc. (a wholly-owned subsidiary of Hess Corporation) in its successful 524(g) Chapter 11 case that resolved hundreds of personal injury lawsuits stemming from alleged exposure to asbestos at an oil refinery in St. Croix.
• In re Chesapeake Energy Corp. — Represent Chesapeake Energy in various proceedings against royalty owners claiming breach of oil and gas leases.
• In re Gulfport Energy Corp. — Defense counsel for Gulfport Energy in various post-bankruptcy actions enforcing the confirmation order and plan.

Guardian ad Litem — Lead trial counsel for minor child in custody dispute.

Grubbs et al. v. O’Neill — Represent inmates seeking to prevent the City of New York from operating surveillance cameras in the attorney-client interview booths in a criminal courthouse. On appeal, won reversal of district court’s decision to allow monitoring. Following that decision and further litigation, the cameras were removed from the interview booths.*
