Dick’s Sporting Goods: Lead trial counsel for Dick’s in a real estate dispute against a mall owner. After obtaining a rare, plaintiff-side partial summary judgment win in a tortious interference case, the parties negotiated a landmark settlement in the middle of a two-week jury trial in the U.S. District Court for the Southern District of Florida.
Hilco Redevelopment Partners: Counsel defending HRP in class action and personal injury suits alleging exposure to dust that migrated offsite after the demolition of a 380-foot chimney in Chicago, Illinois.
Tenet Healthcare: Counsel for Tenet in multiple breach of contract disputes related to the sale of five hospitals in Miami. Prevailed in net working capital arbitration and two separate injunction proceedings in Delaware and Texas. In two separate litigations in Delaware, obtained summary judgment on multiple claims totaling over $50 million.
Caterpillar: Represented Caterpillar in defending against Section 1782 requests for discovery for use in a foreign proceeding. Defeated the petition seeking discovery of Caterpillar and successfully defended the decision on appeal to the Seventh Circuit.
Vantage Specialty Chemicals: Counsel defending Vantage in suits alleging personal injury and class claims based on exposure to ethylene oxide from a production facility in Gurnee, Illinois.
United Surgical Partners Int’l: Counsel defending USPI in class-action lawsuit alleging breach of stock option plan. Won motion striking class allegations, setting stage for consensual resolution.
In re HH Liquidation, LLC: Represented Comvest Equity Partners, LLC, its former portfolio companies, and individual defendants against the Official Committee of Unsecured Creditors, related to an investment in a grocery store brand. After a week-long trial, defendants prevailed on all 78 counts, including claims for fraudulent transfer, constructive fraud, breach of fiduciary duty, substantive consolidation, recharacterization and equitable subordination.
Teva Pharmaceuticals et al. v. UnitedHealthcare: Represented Teva in a suit against UnitedHealthcare to enforce a settlement agreement that resolved longstanding reverse-payment antitrust claims related to the drug Provigil. After a week-long trial, the court ruled in favor of Teva.
Abbott Laboratories v. Alere, Inc.: Represented Abbott in its merger dispute with Alere. After filing a lawsuit to terminate the merger, conducted aggressive discovery during a highly compressed trial schedule, and ultimately helped Abbott secure a purchase price reduction of approximately $500 million.
BankDirect Capital Finance, LLC v. Capital Premium Financing, Inc.: Counsel for Capital Premium in breach of contract, fraud, and trade secret dispute related to the marketing and funding of insurance premium finance products.
TransUnion v. Equifax: Represented TransUnion in a breach of contract dispute with Equifax. After filing the lawsuit and conducting significant discovery, helped TransUnion secure a favorable settlement.
Institute for Justice v. Illinois Department of Financial and Professional Regulation: Counsel for the Institute for Justice in an effort to vindicate its rights under Illinois’s Freedom of Information Act. On appeal to the Illinois Supreme Court, secured a unanimous opinion that the Institute was entitled to the requested documents and attorneys’ fees, while also establishing a new framework for evaluating the retroactive application of new laws in Illinois.
