Court Rejects FTC Bid to Block Merger
Washington, D.C., federal judge, James Robertson, denied the Federal Trade Commission's request for an injunction to block a merger between two baby-food makers, Beech-Nut and Heinz. This action created a new precedent that will no doubt be tried by other companies who try to merge in a highly concentrated market.
Tefft Smith and Mark Kovner's successful representation allowed their client, Milnot Holding Corp., owner of Beech-Nut Nutrition, to continue with the $185 million merger.
