More Companies Avoid Lawsuits — Unless There’s a Potential Big Payout
"Chris Mizzo, an IP partner at Kirkland & Ellis, sat down with Inside Counsel to discuss why companies are less likely to engage in lawsuits unless there could be a big payout.
'Given this atmosphere of obligation and uncertainty, there needs to be a light at the end of the tunnel, something to make it all worthwhile,' he explained. 'For some, that something is the potential for a big payout. In many cases, it may provide the business justification needed to file suit in light of all of the recent changes in law that make it tougher to prevail in an IP lawsuit.'”
