Representative Matters
Since joining Kirkland, Daniel has been involved in the following matters:
Bristol-Myers Squibb and its officers, defended and won back-to-back dismissals of a purported securities class action filed in the U.S. District Court for the Southern District of New York arising out of a drop in the company’s stock price following negative drug trials. Affirmed on appeal by the U.S. Court of Appeals for the Second Circuit.
Six Flags and its former CEO and CFO, defending in purported securities class action and related derivative litigation consolidated in Texas federal court regarding the construction of new theme parks in China.
EQT Corporation and certain of its officers and directors, defending in a consolidated putative securities class action filed in Pennsylvania federal court arising out of its $6.7 billion acquisition of Rice Energy.
Liqui-Box, a portfolio company of Olympus Partners, represented in litigation filed in New York federal court arising from its $585 million acquisition of the plastics division of D.S. Smith.
J.C. Flowers, represented in a dispute filed in New York federal court and related appeal arising out of the purchase of HSH Nordbank AG.
Barnes & Noble, defended appeal in a purported consumer class action lawsuit in New York federal court concerning digital privacy related to social media.
