Overview

Morty Dubin is a litigation partner in the New York office of Kirkland & Ellis LLP. Morty is a first chair trial lawyer known for developing innovative and successful trial defenses for clients in high stakes product liability matters. He has tried and won cases for The Dow Chemical Company, Johnson & Johnson and others throughout the most difficult jurisdictions in the United States. In recognition of his success and standards of practice, Morty has been elected by his peers into the American College of Trial Lawyers.

Morty has been regularly selected by Benchmark Litigation as one of the Top 100 Trial Lawyers in the United States and was their Top Product Liability Litigation in the United States in 2021. In 2024, Morty was named one of 10 Powerhouse Trial Attorneys for his representation of Johnson & Johnson in its cosmetic talc litigation by Courtroom View Network (CVN). He has been ranked nationally for Products Liability & Mass Torts by Chambers USA for ten years, including a Band 1 ranking for Toxic Torts and a Band 4 ranking for Mass Torts. The publication recognized him as “an experienced mass torts litigator with a particular strength in asbestos related matters.” Clients interviewed by Chambers noted that he is “one of the top trial lawyers for our company” and “one of the best defense lawyers in the country in terms of mass torts.” He is also recommended by The Legal 500 United States, with the publication commenting that he is “noted for his trial skills, which have been put to good use in many high-profile product liability matters, including for Johnson & Johnson in its cosmetic talc litigation.” He was also selected by corporate counsel as a BTI “Client Service All-Star.” In addition to his product liability work, Morty also has experience with a broad range of commercial work.

Prior to joining Kirkland, Morty was involved in the following matters:

  • National counsel for Johnson & Johnson in cases involving alleged asbestos contamination of its talcum powder products. Morty secured multiple trial victories for Johnson & Johnson in jurisdictions nationwide, including a defense verdict in the company’s first trial alleging that asbestos contamination in talcum powder caused mesothelioma. Morty also represented Johnson & Johnson in pharmaceutical claims alleging that Elmiron®, a medication for treatment of interstitial cystitis, was associated with development of eye disease.
  • National counsel for The Dow Chemical Company’s subsidiary, Union Carbide, in its asbestos litigation. He was responsible for the development and coordination of national trial strategy and supervision of trials throughout the U.S. For several decades, he also served as trial counsel for the corporation’s most challenging cases. Morty represented The Dow Chemical Company in a variety of product, environmental and commercial liability matters, including the defense of groundwater contamination claims brought by the Suffolk County Water Authority and individual cases arising from alleged exposure to trichloroethylene/trichloroacetic acid (TCE/TCA), methylene diphenyl diisocyanate (MDI), vinyl chloride and hydrogen chloride.
  • Trial counsel for Tekmira Pharmaceuticals Corp. in Massachusetts state court. Tekmira alleged that Alnylam had misappropriated Tekmira's secret RNAi delivery and manufacturing technology, including by applying for patents on technology developed by Tekmira and by passing off Tekmira’s technology as its own.
  • Trial counsel for PricewaterhouseCoopers LLP in Serino v. Lipper (New York Supreme Court), which centered upon allegations of accounting malpractice.
  • Trial counsel for Deloitte & Touche LLP in an action brought in Connecticut by the insurer of Conning Corporation and its wholly-owned subsidiary, Conning & Company.
  • Trial counsel for Brooklyn In Touch in an employment action involving allegations of discrimination and breach of contract.
