VanCleave v. Abbott Laboratories: Trial counsel for Abbott in 17-day trial in California state court successfully defending certified consumer class action challenging labeling of PediaSure children’s nutritional supplements. Plaintiffs contended that the label misled consumers into believing that PediaSure was healthy and nutritious, when it allegedly was not on account of its sugar content. Following nearly six years of litigation, jury returned complete defense verdict in Abbott’s favor after three hours’ deliberation, finding that none of the challenged labeling statements were false and misleading nor material to the plaintiffs’ purchases, and that neither of the named plaintiffs were harmed in any way. Victory earned Litigator of the Week honors from The American Lawyer.

Johnson v. Lewis: Trial counsel to prisoner in Eighth Amendment case alleging deliberate indifference of several prison officials to his Hepatitis C infection, including conducting cross-examination of only living remaining defendant. Case resulted in a judgment for Plaintiff against both defendants.
