Since joining Kirkland, Keith has been involved in the following matters:

• St. Louis Regional Convention And Sports Complex Authority, et al., vs. National Football League, et al.: Trial counsel for the Los Angeles Rams and its owner, E. Stanley Kroenke, in a multibillion-dollar breach of contract and fraud lawsuit arising from the 2016 relocation of the Rams football club to Los Angeles. Settlement achieved in 2021.
• In re Insulin Pricing Litigation: Trial counsel for Eli Lilly and Company in putative class action, and related nationwide lawsuits, challenging pricing practices by insulin manufacturers. Case pending in the U.S. District Court for the District of New Jersey.
• IBM Confidential Arbitration: Represented IBM in significant arbitration involving an IT/contract dispute. IBM was awarded the full amount of its damage claim, plus millions in pre-judgment interest. Representation included defending and taking multiple depositions, as well as presenting direct and cross examination of witnesses at the arbitration hearing.
• Campus Oaks Apartments 1, LLC v. BBC Roseville Oaks, LLC: Trial counsel for Bixby Bridge Capital affiliate in Placer County, California state court involving land purchase and sale. Following a three-week trial, the jury returned a complete defense verdict, including damages for defendant on its counterclaim.
• In re Blue Cross Blue Shield Antitrust Litigation (MDL 2406): Trial counsel for Health Care Service Corporation in a series of putative class action lawsuits filed across the country challenging the structure of the Blue System of health insurance under antitrust laws. Cases pending in MDL in the U.S. District Court for the Northern District of Alabama.
• In re Cobalt International Energy, Inc.: Represented Cobalt International Energy, Inc., and its subsidiaries in litigation matters stemming from their Chapter 11 cases in the United States Bankruptcy Court for the Southern District of Texas. Cobalt was an independent offshore exploration and production company with assets in the deepwater U.S. Gulf of Mexico and offshore West Africa with approximately $2.8 billion of funded indebtedness. After a hotly contested plan process, the bankruptcy court confirmed Cobalt’s Chapter 11 plan in April 2018.
• Lupin Pharmaceuticals, Inc.: Represented global pharmaceutical company in federal and state False Claims Act actions involving allegations of Medicaid fraud.
