Evan Sills is a partner in the International Trade and National Security Practice Group in the Washington, D.C., office of Kirkland & Ellis LLP. Evan has extensive experience in matters involving the Committee on Foreign Investment in the United States (CFIUS) as well as cybersecurity, data security and regulatory compliance issues.
Prior to joining Kirkland, Evan served as counsel at a boutique law firm concentrating on U.S. national security regulatory processes. Previously, Evan served in the Department of Justice (DOJ) as part of the Foreign Investment Review Section of the National Security Division where he oversaw a range of CFIUS and Team Telecom national security agreements, as well as participated in numerous negotiations on similar agreements.
Evan’s practice includes:
- Representing investors and companies in a range of industries in assessing and achieving compliance with their DSP obligations, including issues arising from foreign investors, vendors and operations. He advises clients on structuring transactions, internal controls and governance frameworks to mitigate regulatory risk while supporting commercial objectives.
- Advising clients on a broad range of cybersecurity and data access issues, including matters involving the U.S. CLOUD Act and related cross-border law enforcement and government access considerations. His work includes advising on compliance strategies, responding to government inquiries and navigating the intersection of data protection, national security and global operations.
- Counseling investors and companies on the CFIUS and Team Telecom processes, including filing, responding to government inquiries, negotiating mitigation agreements and compliance
- Leading assessments and compliance reviews of complex data security, cybersecurity and national-security related regulatory matters
- Managing regulatory national security issues in transactional matters, including due diligence, investigation, disclosure, and post-signing and -closing national security filings.
