Commercial Litigation

• Lead counsel defending government contractor against trade secrets and unfair competition litigation concerning award of a $1 billion FAA contract — personally arguing at two summary judgment hearings resulting in a 62-page decision dismissing all claims. See Washington Consulting Group v. Raytheon, et al., D.C. Sup. Ct. Case No. 2010 CA 000296 B, appeal dismissed, D.C. Ct. App. Case No. 13-CV-357 (2013).
• Lead counsel for corporate plaintiff in trade secrets litigation against major competitor over efforts to win a U.S. Navy procurement — defeating motion to dismiss and securing competitor’s agreement to firewall affected employees. See Raytheon v. Lockheed, U.S.D.C. - E.D. Va. Case No. 05-CV-00756 (2005).
• Trying and winning multiple arbitrations on behalf of insurance company faced with allegations of “redlining” — and then arguing winning Third Circuit appeal. See Bazzone v. Nationwide, 2005 WL 351250 (3d Cir. 2005).
• Trying deal dispute concerning Material Adverse Change (MAC) clause in acquisition agreement — handling expedited proceeding to develop and present all experts from start to finish in three weeks, leading to successful completion of $1 billion transaction after first day of trial.

Class Actions

• Lead counsel for consumer products manufacturer faced with class action alleging false marketing and labeling concerning the recyclability of its products. See Garvey v. S.C. Johnson & Son, Inc., U.S.D.C. - N.D. Cal. Case No. 23-CV-01518.
• Lead counsel for contact lens distributor in MDL class actions alleging horizontal and vertical conspiracies to establish minimum retail pricing policies in violation of federal and state antitrust laws. See In re Disposable Contact Lens Antitrust Litigation, U.S.D.C. - M.D. Fla. Case No. 15-MD-2626.
• Lead counsel for consumer products company in MDL class actions alleging false advertising in the marketing of its antibacterial hand wash products — initially defeating class certification and then handling contested evidentiary hearing leading to settlement for less than defense costs. See In re Dial Complete Marketing and Sales Practices Litigation, U.S.D.C. - D.N.H. Case No. 11-MD-2263.
• Defeating nationwide class actions alleging that drug makers colluded to delay generic competition — arguing successful motion to dismiss all claims against client. See In re Effexor XR Antitrust Litigation, 2014 WL 4988410 (D.N.J. 2014).
• Defeating nationwide class actions against four pharmaceutical companies — arguing at class certification hearing to achieve a ruling rejecting class and dismissing all claims. See Altman v. Bayer, et al., N.Y. Sup. Ct. - N.Y. County Index No. 603820/00 (2003).

Product Liability and Environmental Litigation 

• Representing defense contractor against class actions alleging groundwater contamination of surrounding residential properties — ultimately securing stipulation from plaintiffs and their counsel acknowledging no threat to health, no diminution in property values, and that no class could properly be certified. See Sher v. Raytheon, U.S.D.C. - M.D. Fla. Case No. 08-CV-889 (2011).

• Winning dismissal of more than fifty product liability actions against radar manufacturer following fatal commercial aviation accident — and then arguing and winning Second Circuit appeal. See In re Air Crash Near Peixoto de Azevedo, Brazil, 574 F. Supp. 2d 272 (E.D.N.Y. 2008), aff’d, 2009 WL 4282112 (2d Cir. 2009).

Government Investigations and Parallel Civil Litigation

• Arguing for — and winning — dismissal of civil RICO action alleging that telecommunications executive conspired with suppliers to violate Foreign Corrupt Practices Act. See National Group for Communications and Computers Ltd. v. Lucent Technologies Inc., et al., 420 F. Supp. 2d 253 (S.D.N.Y. 2006).

• Defending multinational company in SEC investigation following two restatements of earnings — ending with no enforcement action of any kind.
