Kirkland's representation of Andersen Consulting against Beverly Enterprises was featured in The National Law Journal's eighth annual list of the year's biggest defense wins. This list includes the top 15 defense victories of 1997, plus an additional 10 honorable mentions.
Beverly sought $15 million in compensatories, plus punitives in excess of $20 million from Andersen Consulting regarding advice that the consulting firm had given on upgrading the nursing home's computer system. On April 25, 1997, the Fort Smith, Ark., jury rejected Beverly's claims and ordered the nursing home chain to pay Andersen $1.87 million.
