U.S. District Judge James Selna in Santa Ana, California earlier this month dismissed class action claims against their client, educational technology company Illuminate Education Inc., related to a data breach involving academic, behavioral and demographic information affecting more than three million students. Selna found the plaintiffs failed to allege a concrete injury under their four separate theories: identity theft, the risk of future identity theft, mitigation costs, or loss of the value of their personal information."
