As U.S.-China strategic competition intensifies — and the political stakes grow larger in the run-up to the 2024 U.S. Presidential and Congressional elections — skepticism over Chinese investment in the U.S. has reached well beyond Washington, D.C. In the past few months alone, approximately two dozen U.S. state legislatures have passed or introduced legislation to regulate, restrict and in some cases, prohibit direct and indirect investments from certain countries, like China. In Florida, for example, state investment restrictions have already had significant impacts on deal structuring, certainty and costs, particularly for financial sponsors.
