• In re Interior Molded Doors Litigation. Currently defending client JELD-WEN in nationwide class action alleging price fixing in the sale of interior molded doors.
• In re Cipro Cases I & II; Sandhaus v. Bayer, et al. Counsel for Barr Laboratories (now part of Teva Pharmaceuticals) defending an antitrust challenge to a so-called “reverse payment” settlement of a Hatch-Waxman patent litigation regarding the drug Cipro® (ciprofloxacin).

Product Liability Litigation

•  Counsel for Abbott in litigation matters nationwide alleging claims for public nuisance, fraud and civil conspiracy related to prescription opioids.

Consumer Products / Class Action Litigation

• Counsel for Abbott in ongoing actions in the Superior Court for the State of California (Santa Clara County), Northern District of California, Eastern District of New York, and Southern District of New York challenging Abbott’s labeling statements on its PediaSure and Ensure products.
• In re: Dial Complete Marketing and Sales Practices Litigation. Counsel for The Dial Corporation in consumer protection class actions challenging the antibacterial qualities of its Dial Complete soaps.

False Advertising Litigation

• Cablevision Systems Corp. v. Verizon. Trial counsel for Verizon in false advertising action in federal district court in New York regarding wireless Internet, television and cellular services. Successfully obtained temporary restraining order barring Cablevision from making false and defamatory claims against Verizon while successfully opposing Cablevision’s motion for preliminary injunction against Verizon’s advertising.
• Counsel for Verizon and Abbott in false advertising challenges before the National Advertising Division of the Better Business Bureau.

Contract Litigation

• American Plant Food v. BASF. Trial counsel for BASF in contract dispute related to supply agreement.
• Conduent Business Services, LLC v. Cognizant Business Services. Counsel for Cognizant in contract dispute related to failed systems implementation.

False Claims Act Litigation

• U.S. ex rel. Oberg v. Pennsylvania Higher Education Assistance Agency (PHEAA). Trial counsel for PHEAA securing unanimous jury verdict in its favor in a $350 million False Claims Act case brought by a former U.S. Department of Education employee. The whistleblower filed suit in the U.S. District Court for the Eastern District of Virginia, alleged that PHEAA, a student lending agency, defrauded the government through a student lending subsidy program.

Labor and Employment Litigation

• FTI, LLC et al. v. Holder et al. Counsel for FTI, LLC and FTI Consulting, Inc. in employment action against three former employees and their new employer alleging that defendants had violated their post-employment non-competition and non-solicitation agreements, resulting in a lift-out of FTI’s Latin America investigations practice.
