Diva Hollis is an intellectual property litigation partner and registered patent attorney in the Washington, D.C., office of Kirkland & Ellis LLP. Her practice focuses primarily on patent infringement litigation as well as trade secret litigation and other intellectual property matters involving a wide variety of technologies, including hardware, pharmaceuticals and medical devices in both federal appellate and district courts and before the U.S. International Trade Commission. She has been recognized in the 2024 edition of The Legal 500 United States for appellate litigation. Clients have described her as an “outstanding up-and-coming young appellate partner.” In 2026, The American Lawyer recognized her team’s win for Astellas Pharmaceuticals with “Litigator of the Week” runners-up honors.
Prior to joining Kirkland, Diva clerked for the Honorable Jimmie V. Reyna of the United States Court of Appeals for the Federal Circuit and for the Honorable Claire C. Cecchi of the United States District Court for the District of New Jersey. Diva was also a patent examiner in the area of medical and surgical devices at the USPTO for over six years.

Representative Matters
Certain Wearable Electroencephalogram Devices and Components Thereof (ITC 2026) — Representing Natus in multi-patent ITC litigation against Ceribell concerning electroencephalogram (EEG) medical device technology.
PACT v. Intel Corp. (Fed. Cir. 2023, 2026) — Represented Intel in securing three successive wins for Intel in the Federal Circuit with complete reversals of all three unfavorable Patent Trial and Appeal Board final decisions. In 2026, her team secured a unanimous decision in the Federal Circuit affirming the district court’s decision to grant summary judgment of noninfringement in favor of Intel.
Astellas Pharma Inc. et al v. Zydus and Lupin (D. Del. 2026) — Represented Astellas, a pharmaceutical brand company, against Zydus and Lupin related to Astellas’ Myrbetriq®, used to treat overactive bladder. After jury selection in a February 2026 trial, the case settled with Astellas receiving several hundred million dollars and ongoing payments for further product sales.
Astellas Pharma Inc., et al. v. Ascent Pharmaceuticals, Inc., et al. (D. Del. 2025) — Represented Astellas in Hatch-Waxman litigation. Following a bench trial in October 2025, her team obtained a directed verdict that Ascent would infringe the claims of the four asserted patents. Following post-trial briefing, the claims of the asserted patents were also found not invalid and not unenforceable, resulting in a complete victory for Astellas. Received “Litigator of the Week” runners-up recognition from The American Lawyer for the win.
Omnitracs v. Platform Science (Fed. Cir. 2024) — Represented Omnitracs (a Qualcomm spinoff) and successfully defended PTAB decision upholding patent owned by Omnitracs related to remotely monitoring large vehicle fleets. Less than two months later, a jury awarded Omnitracs $19 million in lost profits for Platform Science’s infringement of that patent.
Certain Mobile Phones, Components Thereof, and Products Containing Same (ITC 2024) — Represented Lenovo and Motorola at the ITC and in district court against Ericsson in global litigation involving 5G standard essential patents (SEPs).
Certain Electronic Devices, Including Mobile Phones, Tablets, Laptops, Components Thereof, and Products Containing the Same (ITC 2024) — Represented Lenovo and Motorola at the Federal Circuit, ITC and in district court against Ericsson.
Microspherix v. Merck (D.N.J. 2023) — Represented Microspherix in litigation related to the infringement of three patents covering implantable contraceptive devices. The case settled favorably just before trial was set to begin resulting in tens of millions of dollars in licensing fees for Microspherix.
Certain Selective Thyroid Hormone Receptor-Beta Agonists, Processes for Manufacturing or Relating to Same, and Products Containing Same (ITC 2023) — Represented Ascletis Pharmaceuticals and related entities in trade secret litigation filed by Viking Therapeutics Inc.
Novo Nordisk Inc., et al. v. Teva Pharmaceuticals USA, Inc. (D. Del. 2023) — Represented Teva in a patent infringement suit arising from Teva’s submission of an ANDA to the FDA seeking approval to manufacture and sell a generic liraglutide injection, a non-insulin injection prescribed for the treatment of type II diabetes. Before the bench trial was to commence, the parties reached a confidential settlement and license agreement.
