Litigator of the Week Runners-Up and Shout-Outs

"... A Kirkland & Ellis patent litigation team secured a win in Delaware federal court for Astellas Pharma Inc. protecting the company’s branded overactive bladder treatment from a generic challenge. After a bench trial last October, U.S. District Senior Judge Joseph Bataillon, sitting by designation from the District of Nebraska, found that a generic version of Astellas’ Myrbetriq proposed by Ascent Pharmaceuticals Inc. infringed four Astellas patents. Last week the judge ordered the FDA to hold off on final approval of Ascent’s generic version until after Astellas’ patents expire in March 2030. Myrbetriq generates more than $1 billion in sales annually in the U.S. for Astellas.
