Overview
Tera Stone is an intellectual property litigation partner in the Washington, D.C., office of Kirkland & Ellis LLP who focuses primarily on complex patent and licensing disputes. Tera has a background in chemical engineering and has represented clients across diverse technology sectors including oil & gas, chemicals, medical devices, pharmaceuticals, agriculture and robotics. Her practice spans federal and state district courts, the International Trade Commission, the United States Patent and Trademark Office and arbitrations, as well as appeals before the United States Court of Appeals for the Federal Circuit. In addition to traditional patent claims and defenses, Tera has experience managing novel equitable claims and defenses, including developing and executing innovative responsive legal strategies. Tera also has extensive experience in all phases of litigation, including pre-suit investigation, taking and defending expert depositions, motions practice, trial and post-trial briefing.

Representative Matters
Represented Astellas Pharma Inc. in Hatch-Waxman litigation against numerous generic manufacturers related to Astellas’s Myrbetriq® used to treat overactive bladder. Following a bench trial victory against Ascent Pharmaceuticals, the team was recognized as runners-up in The American Layer’s “Litigator of the Week.”
Represented multiple oilfield services companies against a major competitor regarding allegedly owed patent royalties. Prevailed at summary judgment on multiple grounds, ending a royalty tax that the adversary argued went for an additional decade and that in the prior decade was publicly reported to have resulted in over $1 billion of royalties to the adversary across the industry. Recognized as runners-up for The American Lawyer’s “Litigator of the Week.”
Represented iRobot Corporation in a successful Section 337 Investigation at the International Trade Commission (Inv. No. 337-TA-1252) as well as related district court litigation and co-pending inter parties review proceedings. Obtained a finding of infringement, resulting in the issuance of an exclusion order against certain SharkNinja robotic floor cleaners. The victory was highlighted in The American Layer, twice resulting in runners-up recognition for “Litigator of the Week.”
Represented Abbott Diabetes Care in global litigation against DexCom related to continuous glucose monitoring devices for individuals with diabetes. Secured a jury trial win on several claims in 2023. The parties reached a global settlement in 2024.
Represented Farmers Edge in the District of Nebraska against a direct competitor asserting patent infringement. After obtaining key admissions throughout discovery, the Court granted summary judgment that the patents were directed to ineligible subject matter under § 101 weeks before the scheduled trial.
Represented a leading energy and technology company in a multi-year, high-stakes arbitration that resulted in key legal wins and a significant financial award in the client’s favor in the final award.
Represented Actavis Laboratories in an appeal before the Federal Circuit concerning a treatment for Parkinson’s disease. Obtained a ruling from the court of appeals affirming the district court’s judgement that all challenged claims were invalid as obvious.
