A team at Kirkland & Ellis helped oil and gas clients Halliburton and Ulterra come out on top in disputes involving patent license agreements with National Oilwell Varco for technology related to diamond-tipped drill bits. The U.S. patents that NOV previously asserted against the companies expired in 2021, but NOV claimed that patents it obtained in the U.S. and abroad extended the term of the royalty agreement through 2031. In rulings unsealed this month, U.S. District Senior Judge Andrew Hanen in Houston found that NOV was barred from collecting royalties on U.S. activity due to the expiration of the U.S. patents. With neither Halliburton nor Ulterra practicing the foreign patents, NOV noted in an SEC filing this week that it would not be able to collect any of the royalties it alleged were owed.
