Kevin Miller is a labor and employment partner in the New York office of Kirkland & Ellis LLP. Kevin’s practice is focused on guiding clients through their most complex and sensitive workforce issues, including managing the onboarding and separations of executives and key employees, effectively addressing allegations of workplace misconduct, implementing broad-based restructurings, assessing wage-and-hour practices, and navigating competition and employee solicitation issues. Clients turn to Kevin for high-touch advice during crisis situations, as well as for day-to-day counseling on a broad range of federal, state, and local employment laws and regulations.
Kevin also routinely advises on the labor and employment aspects of U.S. and multinational M&A transactions and restructurings — particularly those involving private equity sponsors — and has represented clients in hundreds of transactions across myriad industries. In this capacity, he leads employment due diligence efforts, negotiates and drafts purchase agreements and transition services agreements, and implements workforce integration plans. Kevin is frequently called upon to prepare and negotiate critical employment-related documents, including executive employment agreements, restrictive covenant agreements, consulting agreements and separation agreements.
Kevin has deep dispute resolution experience, having represented clients in all phases of litigation in state and federal court and before arbitral panels and administrative agencies. In particular, he has significant experience litigating non-compete, non-solicitation, trade secret theft and complex compensation-related matters.
