Litigator of the Week Runner-Up and Shout-Outs

Shout-out to a Kirkland & Ellis team led by partners Aaron Marks and George Hicks, who helped client Tomales Bay Capital and its managing member Iqbaljit Kahlon secure a win at the Delaware Supreme Court against China’s Leo Group Co. in a high-profile dispute regarding investments in SpaceX. Last week, the state’s high court upheld a Chancery Court decision that largely sided with Tomales Bay and Kahlon, with the exception of a single claim for breach of the duty of candor regarding Kahlon’s conversations with SpaceX CFO Bret Johnsen. Leo Group’s win on that claim resulted in nominal damages of $1 and an award of attorney fees—the latter of which the Supreme Court overturned last week. “This single finding in favor of Leo Group does not warrant a fee award of nearly $16 million to compensate Leo Group for litigating a case that it lost on almost every issue,” wrote Justice Abigail LeGrow.
