Litigator of the Week Runners-Up and Shout-Outs

Shout-out to a team at Kirkland & Ellis for getting the firm’s earlier win for client Sun Pharmaceutical Industries Ltd. and its Ranbaxy subsidiaries to stand up on appeal in a case where the company faced claims it conspired with Pfizer to delay a generic version of the blockbuster cholesterol drug Lipitor. Last week, a Third Circuit panel upheld the summary judgment ruling below, as well as a ruling denying class certification. The appellate court held that the plaintiffs lacked concrete evidence that the U.S. Food and Drug Administration would have approved the generic version of Lipitor sooner if not for an earlier settlement between the companies. The team was led by partner Devora Allon and retired partner Jay Lefkowitz, who both argued for Sun Pharma at the Third Circuit, and included partners George Hicks, Gilad Bendheim and Kristopher Morton, who led the briefing, and partners Christopher Fernandez, Amanda Lamothe-Cadet and Megan McGlynn Butler and former partners Alexandra Russell and Kyla Jackson."
