Shout-out to a team at Kirkland & Ellis that secured a unanimous ruling from the Public Service Commission of South Carolina clearing the path for client Valara Holdings to move forward with a data center and power plant project in Spartanburg County. The PSC held that it lacked jurisdiction over petitions from environmental and citizen groups seeking to subject the project to the approval process for public utility plants because its power facilities would not deliver electricity to the public grid.
