Litigator of the Week Runners-Up

In the last trial before U.S. District Judge Alan Albright steps down from the bench later this month, a team at Kirkland & Ellis secured a major win for GD Energy Products in patent litigation with UTEX Industries Inc. related to header rings used to help seal fracking pumps. Last week, a Waco, Texas, jury found that GD Energy’s redesigned Redline+ header ring did not infringe the asserted claim of UTEX’s last patent standing at trial. What’s more, jurors found that the Redline+ was covered by a covenant not to sue that was part of an earlier settlement agreement between the parties, and that the asserted claim was invalid due to obviousness.
